The New York Times reports that Shulman's lawyer, Alan M. Shapey, has asked a Manhattan court to order the long-running musical — including producer Universal Pictures and theatre owner the Nederlander Organization — to preserve evidence that may have caused the injury "for the purposes of framing a complaint."
Shulman, who has not worked since the incident, was reportedly injured while she was playing a flying monkey approximately 15 feet above the stage. According to a motion filed in Manhattan's State Supreme Court, "it appears the rope snapped, dropping her 15 feet to the ground below."
Among the evidence in question are harnesses, cables and ropes that were utilized the night of the injury.
Following the incident, Shulman was taken to the hospital by ambulance. Although an initial workers' compensation claim lists her injury as a shoulder strain, her lawyer says the 35-year-old actress has also suffered neurological damage.
Shulman declined an interview with the Times, although Wicked spokesperson Tom D'Ambrosio said, "[Thursday's] hearing [on the motion] was a standard procedure but, as this is an ongoing legal matter, we are unable to comment further."
